DISGRACED former Clarence MP Steve Cansdell has escaped prosecution over falsifying a statutory declaration to avoid losing his licence over a speeding fine.

Mr Cansdell resigned in a cloud of controversy on September 16 last year after walking into Grafton police station that morning and handing them a speeding fine with a falsified statutory declaration on the back signed by former staffer Kath Palmer.

Following lengthy inquiries by police, a brief of evidence was forwarded to the Commonwealth Director of Public Prosecutions for consideration.

The DPP has recently advised investigators that it's not satisfied there are reasonable prospects for conviction for a Commonwealth offence, as is required under the Prosecution Policy of the Commonwealth to enable a prosecution to be conducted.

Based on that advice, NSW Police Force will not instigate criminal proceedings against the man.
