  1. 797389v2 Notice of Intention to Do a Future Act Description of the Future Act Pursuant to Section 135 of the Crown Lands Act 1989 (NSW) and Section 7 and 11 of the Land Acquisition (Just Terms Compensation) Act 1991 (NSW), the Minister for Lands for the State of New South Wales intends to acquire by compulsory process for the public purposes of Public Recreation, Tourist Facilities and Services, Access, Rural Services, Environmental Protection and Heritage Purposes, the land and aIl interests therein including native title rights and interests (if any) in the property at Boyds Bay Tweed Heads indicated by bold line and black hatching on the diagram and described in the Schedule hereto as Lot 7050 in Deposited Plan 94185 and Lot 7340 in Deposited Plan 1166612 (hereinafter described as the Iand). It is intended that the land will then be developed by a private developer as a commercial marina serving the interests of the boating public. Time At Which the Act is Intended to Be Done The compulsory acquisition of the land will occur if and when the Minister is allowed to validly do so under the Commonwealth Native Title Act 1993 and when the Minister is able to do so in accordance with the Land Acquisition (Just Terms Compensation) Act 1991 (NSW). This will take effect from the date of publication in the NSW Government Gazette of an Acquisition Notice pursuant to Section 19 of the Land Acquisition (Just Terms Compensation) Act, 1991 thereupon extinguishing all interests in the land and converting them to a claim for compensation. Notification Period The Section 30 of the Native Title Act 1993 (Cth) allows three (3) months after the Notification Day for persons to take certain steps to become native title parties in relation to this Notice. The Notification Day commencing this claim period will be the date the notification notice is sent out. Proposed Acquisition Notice and Claim for Compensation form Any person claiming an interest in the land should notify the Minister for Lands to ensure that they obtain a Proposed Acquisition Notice and a Claim for Compensation form from the Acquiring Authority when the Proposed Acquisition Notice issues. Enquiries about becoming a Native Title Party Only persons who are native title parties within the meaning of the Native Title Act 1993 will have the negotiation and other rights accorded under Part 2, Division 3, Subdivision P of that Act. The time and procedure for becoming a native title party are set out in that Act. Enquiries in this regard should be directed to the National Native Title Tribunal Sydney Registry.
